GENERAL RULES AND REGULATIONS FOR ONLINE PROMOTIONS

Application:
These rules and regulations shall apply to all on-line contests (the “Contest”) unless stipulated otherwise, and where alternate rules and regulations are made available to the public. If there are any discrepancies between these rules and regulations and any other rules and regulations posted for any particular Contest (the “Alternate Rules”), such discrepancy shall be resolved in favour of the Alternate Rules.
Eligibility:
The Contest is open to legal residents of Canada who have reached the age of majority in the province in which they reside. No person who is employed by the JPBGLP or its affiliate companies and no family member of such employee shall be entitled to enter the Contest.
In certain cases, minors under the age of majority will be permitted to enter the Contest and be eligible to win the prize. In no case, however will a minor be declared a winner without the prior written consent and release of liability of the minor’s parent or legal guardian.
How to Enter
There is no purchase necessary to enter the Contest.
Enter the contest by clicking on the “Enter Contest Here” button on the web-site.
Winners will be chosen by random draw, unless specified otherwise eg: Special On-line Contest.
Upon being declared a potential winner, the caller will be required to answer, unaided a time-limited mathematical skill testing question. Upon correctly answering that question, the potential winner will be declared the winner.
Value
No Prize may be exchanged for cash, sold or transferred to any third party.
Odds of Winning
The odds of winning the Contest are dependant on the number of entrants attempting to enter the Contest at any given time.
Liability
The winner acknowledges that the collection or use of the prize may be inherently dangerous and agrees to release and hold harmless the JPBGLP for any and all damages he may incur through entering the Contest or through the collection or use of the prize. The winner also agrees to sign a standard release and waiver of liability prior to claiming the prize which will generally be provided.
Each entrant and any potential or declared winner releases the JPBGLP, their subsidiaries, respective divisions, their parent corporations, their advertising and promotional agencies, their shareholders, officers, directors, employees, agents and representatives (hereinafter the “Beneficiaries”) from any and all liability for any and all damage, loss or liability suffered as a result of or arising from the entrant’s participation in the contest or the acceptance or use of his/her prize. In order to be declared a winner and prior to obtaining his/her prize, any potential or declared winner agrees to sign a declaration to such effect in the release form. The guest of a winner (or a parent or legal guardian in the case of a minor) will also have to sign such a declaration to that effect in the release form, failing which they will not be able to take part in the prize.
Facebook Contests
All Facebook contests held by 100.3 The Q! / The Zone @ 91-3 (CKKQ / CJZN) are in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the contest, you are acknowledging this rule and completely releasing Facebook for any and all damages you may incur through entering the Contest or through the collection or use of the prize.
Release of Privacy Rights
By entering this contest, each declared winner consents to the contest organizers, their representatives to use, at their sole discretion and if required, their name, photograph, likeness, testimonial related to the prize, place of residence and/or voice without compensation whatsoever and that, without limit as for the period of use, in any media and on a worldwide scale, for publicity purposes or for any purpose that may be considered relevant.
General
Prize winners shall be responsible for all costs and expenses not explicitly stated to form part of the prize, including but not limited to taxes, fees, gratuities, insurance, or travel to and from the airport where a prize includes travel.
Where the Prize includes travel, the Prize winner must ensure that he and his companion have all the necessary travel documents required to travel to the destination on the dates specified in the prize description.
Prior to receiving the Prize, the Prize winner shall sign a standard release and liability waiver absolving the JPBGLP of all its obligations under the Contest and accepting the Prize as awarded as full and final satisfaction of all items owed to him by the JPBGLP.
The JPBGLP may at its sole discretion substitute a prize or a portion thereof with an alternate prize of equal or greater value. Notwithstanding the foregoing, the JPBGLP shall not be responsible to substitute a prize or portion thereof where such prize can not be redeemed due to factors beyond its reasonable control.
In the event it is impossible, difficult and/or more costly for the JPBGLP to award a prize (or part of a prize) as described in these contest rules, the contest organizers reserve the right to award a prize (or part of a prize) of similar nature and equivalent value or, at their sole discretion, the value of the prize (or of the part of the prize) in cash.
The JPBGLP reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the contest as provided in these contest rules.
All decisions of the JPBGLP or those of their representatives regarding this contest are final and binding.
By entering the Contest, all persons are deemed to have read and to have accepted these rules and regulations.
CKKQ THE Q BC FERRIES VACATIONS SPRING BREAK RETREAT 2019 CONTEST
OFFICIAL RULES & REGULATIONS
(the “Rules”)
The CKKQ The Q BC Ferries Vacations Spring Break Retreat Contest (the “Contest”) starts at 6:00 a.m. Pacific Time (“PT”) on February 4, 2019 and closes on February 14, 2019 at 11:59 p.m. PT (the “Contest Period”). No purchase necessary. Void where prohibited.
The Contest sponsors are Jim Pattison Broadcast Group Limited Partnership and British Columbia Ferry Services Inc. (hereinafter referred to as the “Contest Sponsors”).
ELIGIBILITY: To enter and be eligible to win, entrant must be a legal resident of British Columbia, Canada and be nineteen (19) years of age or older. Employees and their spouses, parents, siblings and children, and persons domiciled with an employee of either of the Contest Sponsors, their respective agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter. A winner of a previous British Columbia Ferry Services Inc. (“BC Ferries”) or Jim Pattison Broadcast Group Limited Partnership contest within the three (3) months preceding the start of this Contest (including persons designated by such winners to take ownership of prizes) and persons domiciled with a winner are not eligible to enter.
TO ENTER THE CONTEST, simply visit the website located at http://www.theq.fm/contests/, click on the Contest page and complete and submit your entry by following the instructions found on the Contest page. All entries must include your name, city of residence, postal code, age, ten digit day and evening telephone numbers and e-mail address. Limit of one (1) entry per eligible individual per day. If it is discovered that you attempted to enter more than once per day, all your entries will be void. Entries shall be deemed to be submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Illegible entries are ineligible. These Rules are the standard terms and conditions applicable to the Contest.
PRIZE: There is one (1) prize available to be won (the “Prize”), consisting of three (3) nights’ accommodation at River Rock Casino Resort for two (2) people in a One Bedroom Marina View Suite based on double occupancy; and round-trip ferry travel with BC Ferries between Vancouver Island and Metro Vancouver for two (2) people travelling in one (1) standard vehicle. The Prize is based on availability at the time of booking, and is valid through February 29, 2020. The Prize has an approximate retail value of One Thousand Three Hundred and Eighty Canadian dollars (CDN $1,380.00). The Prize is based on availability of accommodation and ferry travel at the time of booking for two (2) adults and one (1) standard vehicle. The Prize has no cash value and gratuities are not included. Blackout dates June 1 – 4, 2019 and December 31, 2019. The Prize winner and his/her travelling companion are solely responsible for all costs not expressly described herein, including, without limitation, as applicable, all transportation (except included ferry transportation), taxes, fuel/currency surcharges, meals and beverages, room service, gratuities, merchandise, telephone calls, insurance, any required travel documentation and all personal expenses of any kind or nature. Accommodation and specific Prize elements are subject to availability and change without notice or compensation. It is the sole responsibility of the Prize winner and his/her travelling companion to obtain all necessary travel documentation including passports and visas (if applicable), and to comply with any customs and immigration requirements, as applicable. It is recommended that the Prize winner and his/her travelling companion obtain sufficient personal insurance prior to departure. The Prize may not be used towards any type of reward point accumulation program. No change in travel arrangements can be made by the winner once his/her booking has been confirmed. In order to take advantage of the Prize, winner and travelling companion will require access to a private vehicle (or alternative means of transportation) at their expense. Departure dates and accommodation are subject to availability and change without notice or compensation. Before being able to participate in the Prize, the winner’s travelling companion (and in the event of a minor travelling companion, his/her legal guardian) will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating that, among other things, he/she has read and understood these Rules, grants all consents required, agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsors and/or similar matters, authorizes the Contest Sponsors to disclose his/her Personal Information (as further defined in Rule 11) publicly inside or outside Canada for the period of one (1) year for the purposes of broadcasting, publishing and disseminating his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the travelling companion, beyond his/her participation in the Prize, accepts the Prize as offered, releases the Contest Sponsors and their respective affiliates and agents (collectively, the “Released Parties”) from any and all liability of any kind arising out of the travelling companion’s participation in this Contest and receipt and use of the Prize and agrees to indemnify the Contest Sponsors for any loss, injury, accident, misfortune or damage which results from any of his/her negligent and/or wilful misconduct in connection with the Contest or the use and/or receipt of the Prize.
Prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of the Contest Sponsors. Any unused portion of the Prize will be forfeited and have no cash value. The Contest Sponsors reserve the right, in their sole discretion, to substitute a Prize of equal or greater value if the Prize (or any portion or component thereof) cannot be awarded for any reason.
DRAW: On or around Friday, February 15, 2019, a random draw for the Prize will take place at Jim Pattison Broadcast Group Limited Partnership, Victoria, British Columbia from among all eligible entries received during the Contest Period. The first entry drawn will be eligible to win the Prize. The odds of winning the Prize will depend on the number of eligible entries received during the Contest Period. Jim Pattison Broadcast Group Limited Partnership, acting reasonably, will attempt to contact the potential Prize winner to notify potential winner that he or she may have won the Prize by telephone within two (2) business days after the draw. In the event that the potential winner cannot be contacted within two (2) business days after the draw, he or she will be disqualified and an alternate potential winner may be drawn at the Contest Sponsors’ sole discretion. Proof of identification must be provided upon request.
In order to be declared the winner, potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Jim Pattison Broadcast Group Limited Partnership. Before being awarded the Prize, the potential winner will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating that, among other things, he/she has read, understood and complied with these Rules, grants all consents required, agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsors and/or similar matters, authorizes the Contest Sponsors to disclose his/her Personal Information (as further defined in Rule 11) publicly inside or outside Canada for the period of one (1) year for the purposes of broadcasting, publishing and disseminating his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner beyond the awarding of or participation in the Prize, accepts the Prize as offered, releases the Released Parties from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the Prize and agrees to indemnify the Contest Sponsors for any loss, injury, accident, misfortune or damage which results from any of his/her negligent and/or wilful misconduct in connection with the Contest or the use and/or receipt of the Prize. In the event that the potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsors shall have the right to disqualify the potential winner, and draw an alternate potential winner, and the Contest Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until a qualified winner has been duly selected, but in any event, no later than Friday, March 8, 2019.
By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules, and will be deemed to have read, understood and complied with these Rules. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.
All entries become property of Jim Pattison Broadcast Group Limited Partnership, which assumes no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with selected entrants and with persons requesting Rules by mail or requesting the name of the Prize winner (for which a self-addressed, postage paid envelope must be included). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials or data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control, Contest Sponsors reserve their right to cancel, terminate, modify, amend, extend or suspend the Contest, and select a winner from previously received eligible entries. Contest Sponsors reserve their right to modify these Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsors reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site.
Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal Information is information about an identifiable individual and includes the Personal Information described in Rule 4 and an entrant’s name, address, age, ten digit day and evening telephone numbers, and e-mail address. Personal Information collected from entrants will be used by Jim Pattison Broadcast Group Limited Partnership for the purpose of implementing, administering and fulfilling this Contest including but not limited to contacting and announcing the winner and, if consent is given at the time of entry, to provide the entrants with marketing information relating to new and existing products and upcoming promotions of Jim Pattison Broadcast Group Limited Partnership by mail or e-mail. Entrants are able to opt-in with respect to receiving such marketing information online. Personal Information of the winner and his/her travelling companion (including name, city, country, postal code, email address and full release and indemnity form) will be collected by and/or shared with BC Ferries for the purpose of Prize fulfilment or other activities as described in these Contest Rules. The Contest Sponsors will not sell, share or otherwise disclose Personal Information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of Personal Information as set out Jim Pattison Broadcast Group Limited Partnership’s privacy policy, which is available at http://www.theq.fm/privacy/, and in the case of the winner’s and travel companion’s Personal Information, also as set out in British Columbia Ferry Services Inc.'s Website Privacy Statement, which is available at https://www.bcferries.com/about/privacy_statement.html. Any inquiry concerning the Personal Information held by the Contest Sponsors should be addressed to Jim Pattison Broadcast Group Limited Partnership at Top Floor, 2750 Quadra Street, Victoria, BC, V8T 4E8. Entrants will have the opportunity to consent to receive information about special offers and promotions from BC Ferries. If an entrant chooses to consent, his/her Personal Information (specifically, First Name, Last Name, Email Address, City, Country and Postal Code) will also be disclosed by Jim Pattison Broadcast Group Limited Partnership to BC Ferries which will use it to administer their subscription in accordance with BC Ferries’ Website Privacy Statement at: https://www.bcferries.com/about/privacy_statement.html.
In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Rules shall prevail, govern and control.
All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
